1. Acceptance of Terms

By accessing or using the Before You Load platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access the Service. The Service is intended for use by freight brokers, carriers, and transportation industry professionals for business due diligence purposes.

2. Description of Service

Before You Load provides carrier risk intelligence based on publicly available government data sources, including FMCSA, DOT, and other federal and state databases. The Service includes carrier scoring, safety analysis, authority verification, and related data products.

The Service is designed for business due diligence only. It is NOT a consumer reporting agency and does NOT produce consumer reports as defined by the Fair Credit Reporting Act (FCRA). The Service may not be used for employment screening, tenant screening, credit decisions, or any purpose governed by the FCRA.

3. User Accounts and Organizations

You must create an account to use the Service. Each account belongs to an organization. Organization administrators are responsible for managing member access and permissions. You are responsible for maintaining the confidentiality of your account credentials.

4. Subscription and Billing

Access to the Service requires a paid subscription. Subscription tiers, lookup limits, and pricing are described at the time of purchase. Lookup overages, if authorized by the organization administrator, are billed at the per-lookup rate of the active plan tier. Subscriptions renew automatically unless cancelled before the renewal date.

5. API and MCP Access

API and Model Context Protocol (MCP) access is included in applicable plan tiers. Each API or MCP request that returns carrier data counts as one lookup against the organization’s monthly allowance. Batch requests count as one lookup per unique USDOT number. API keys are organization-scoped and must not be shared outside the organization.

6. Data Accuracy and Disclaimers

The Service presents data derived from publicly available government sources. While we employ rigorous data processing, we do not guarantee the accuracy, completeness, or timeliness of any data presented. Government source data may contain errors, delays, or omissions beyond our control.

Risk scores, decision states, and safety percentiles are our own independent calculations and do NOT represent official FMCSA SMS percentiles or government determinations. They are provided for informational and due diligence purposes only.

7. Limitation of Liability

8. Indemnification

9. Intellectual Property

The scoring methodology, proprietary signal weights, and risk calculation formulas are trade secrets of Before You Load. Users may not reverse-engineer, decompile, or attempt to extract the underlying algorithms. Government source data remains in the public domain.

10. Termination

Either party may terminate the subscription with 30 days written notice. We may suspend or terminate access immediately for violation of these Terms. Upon termination, organization data is retained for 90 days, after which it is permanently deleted (excluding audit logs required by law).

11. Governing Law
